Kenneth Lilly Charged With Attempted Murder In I-35W Bus Driver Shooting

The 31-year-old St. Paul man was charged with one count of attempted second-degree murder as well as a second count of second-degree assault with a risky weapon.

Investigators said Lilly works as an armed security guard and became angry after a minor accident with the bus.

Lilly will appear in Hennepin County Court on Friday.

Video, released by the Minnesota Department of Transportation Wednesday, shows suspected gunman Kenneth Lilly pull over on the highway's shoulder, get out of his auto and walk toward the bus.

Police said 31-year-old Kenneth Lilly fired five shots at the 78-year-old school bus driver who bumped his auto on an icy interstate, hitting him in the head and arm. An 8-year-old child also on the bus was not injured.

The traffic camera footage released by police shows the bus, a pick-up truck and a sedan pull over to the side of the slow-moving vehicles going bumper to bumper on I-35.

The complaint said the bus driver was trying to merge onto the interstate in inclement weather when the bus scraped Lilly's vehicle.

Lilly then walked to the driver's side of the bus and called 911. He walked to the passenger door and reportedly tried to get onto the bus.

"The filing of the complaint tells you that we do not believe there was a self-defense claim based upon the evidence we have received so far", Chief Deputy Hennepin County Attorney David Brown told reporters.

The complaint says Lilly pulled out a pistol and fired at the bus windshield, wounding the driver in the left arm and grazing his head.

Law enforcement authorities responded to a report of a shooting on the interstate at Chicago Avenue in Minneapolis at 2:14 p.m. Tuesday. Lilly told officers that he feared for his safety and that is why he shot at the bus driver.
