Weinstein seeks to get case tossed, citing accuser’s emails

In an email sent from one of Weinstein's accusers on January 5, 2014, ten months after the alleged rape in March 2013, she writes, "Your (sic) the one who makes it look good with your smile and lovely eyes!"

On Friday, his lawyers filed a defence motion citing dozens of "warm" emails they say Mr Weinstein received from one of his accusers after an alleged rape. Allred asked, adding that a grand jury "would not have indicted him if they did not find the testimony that they heard credible".

Mr Weinstein has pleaded not guilty to six charges involving three different women.

The attorneys have sought permission from the Weinstein Co. estate and from the committee of unsecured creditors, which represents some of Weinstein's accusers in civil court, to publish the emails in question.

Brafman has said witnesses can corroborate Weinstein's denials of the criminal charges, which the lawyer has called a product of political pressure to prosecute Weinstein amid the #MeToo outcry.

The emails and text messages - allegedly sent and received through Weinstein's official company account and phone - were obtained by his legal team earlier this year after a bankruptcy judge in DE granted access to them for his criminal defense.

"These communications irrefutably reflect the true nature of this consensual intimate friendship, which never at any time included a forcible rape".

Vance's office declined to comment Friday.

Where did these emails come from? When he was sacked, the company wouldn't let him access the account. His lawyers got access, but the bankruptcy judge issued a protective order prohibiting them from disseminating the emails.

I am happy about it. "He's obviously won the Golden Glove at the World Cup, and he had a fantastic tournament". I spoke yesterday with him about his lateness, not about his future.

Amidst the recent confusion of a sex for jobs interview that was then walked back and a short-lived dust-up with his former crisis PR team over fees, Harvey Weinstein now looks to tackle the multiple sex crimes case that could see him behind bars for life.

What are the cases against him?

The charges stem from allegations from three women, according to court documents.

The accusations against Weinstein led to the #MeToo movement in which hundreds of women publicly accuse powerful men in business, politics and entertainment of sexual harassment and abuse.

Mr Weinstein has consistently denied any non-consensual actions.

The producer pleaded not guilty and is now out on a $1 million bail along with Global Positioning System tracking, so he can't leave the country.

In April, actress Ashley Judd sued him, claiming he damaged her career after she rejected his sexual advances.

"As awful a crime as rape is, it is equally reprehensible to be falsely accused of rape, and since Mr. Weinstein has denied these allegations, that's where we are".
